HullRecords provides underwater images and video of vessel hulls using a remotely operated vehicle (ROV). We do not perform marine surveys or provide opinions about a vessel's safety, value, or condition. Our reports are limited, visual records of what was observable at the time of imaging and should not be relied upon instead of a professional marine survey. Use of our services means you agree to the terms below, including limits on liability.

1. Nature of Services

HullRecords provides underwater visual imaging and documentation services using remotely operated vehicle (ROV) technology.

All services are strictly limited to the capture and delivery of photographic and video media, along with descriptive observations based solely on what is visually observable at the time of service.

HullRecords:

Any written report or commentary provided by HullRecords is descriptive only and limited to visible features captured in imagery. No representation or warranty is made regarding the overall condition of the vessel.

2. No Reliance / Third-Party Use

All deliverables, including reports, images, and video, are provided solely for the use of the contracting client.

No third party may rely on HullRecords's deliverables for any purpose, including but not limited to:

Any reliance by a third party is expressly prohibited and undertaken at that party's sole risk.

Clients may not distribute, publish, or provide HullRecords deliverables to third parties for reliance purposes without prior written consent from HullRecords.

3. Limitations of Service

Client acknowledges that the services are inherently limited by environmental and operational conditions, including but not limited to:

HullRecords does not guarantee that all portions of a vessel's hull or underwater components will be imaged or visible.

Conditions observed are limited to the specific date and time of service and may change immediately thereafter. HullRecords assumes no obligation to update or revise deliverables.

4. Recommendation for Professional Marine Survey

HullRecords strongly recommends that clients retain a qualified, licensed marine surveyor for any decision involving:

5. Client Responsibilities

The client agrees to:

HullRecords will not board any vessel without explicit permission and is not responsible for delays or inability to perform services due to access limitations.

6. Payment, Deposits, and Cancellation

A deposit is required to reserve a service appointment and will be applied toward the total service fee.

HullRecords reserves the right to reschedule or cancel services due to weather, water conditions, safety concerns, or equipment issues. In such cases, deposits may be refunded or applied to a rescheduled appointment.

7. Deliverables and Intellectual Property

Upon full payment, the client is granted a non-exclusive, perpetual license to use the specific images, video, and report delivered for personal or internal business purposes.

HullRecords retains all ownership and copyright in all media produced.

Client grants HullRecords a non-exclusive, royalty-free license to retain and use captured media for:

Commercial or public use of identifiable vessel media by HullRecords will require separate written consent from the vessel owner.

8. Data and Privacy

HullRecords may retain service-related data, including media and reports, for operational, archival, and analytical purposes.

HullRecords does not sell identifiable client or vessel data to third parties.

Requests for deletion of data may be considered but are not guaranteed unless required by law or contract. HullRecords reserves the right to retain anonymized or non-identifiable data indefinitely.

9. Limitation of Liability

To the fullest extent permitted by California law:

Client agrees to indemnify, defend, and hold harmless HullRecords and its owners, operators, and agents from any claims, damages, liabilities, or expenses arising out of:

Client agrees not to publish, distribute, or use HullRecords deliverables in a manner that:

HullRecords reserves the right to deny or revoke permission for use of deliverables in such contexts.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed under the laws of the State of California.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco County, California.

At HullRecords's discretion, disputes may be submitted to binding arbitration in San Francisco under applicable California arbitration rules.

HullRecords shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:

These Terms constitute the entire agreement between the parties regarding the services provided.

HullRecords reserves the right to modify these Terms at any time. Updated Terms will be effective upon posting to HullRecords's website.

Continued use of services constitutes acceptance of any revised Terms.

By booking or using HullRecords services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
